These Wireless Internet Access Terms of Use (“Terms”) govern access to and use of wireless internet service and related network resources provided by the Millersville Rural Fire Protection District (“District” or “MRFPD”).
By connecting to, accessing, or using an MRFPD wireless network, the user acknowledges that the user has read, understands, and agrees to comply with these Terms. Users who do not agree to these Terms must immediately disconnect from the network.
1. Purpose of the Service
MRFPD may provide wireless internet access as a convenience to authorized District members, employees, volunteers, contractors, visitors, guests, and members of the public.
Providing wireless internet access does not create a right or entitlement to continued service. MRFPD may restrict, suspend, modify, or discontinue access at any time, with or without notice.
District operational, emergency-response, communications, and public-safety systems shall receive priority over all personal or guest internet use.
2. Authorized Use
The wireless network may be used for lawful purposes consistent with these Terms and all applicable District policies.
Authorized users may use the network for:
Official MRFPD operations and District business;
Training, education, and professional development;
Emergency-services communications and support;
Reasonable personal internet use that does not interfere with District operations;
Other purposes approved by the Fire Chief, Board of Directors, or authorized Information Technology administrator.
Users shall not attempt to access internal District systems, equipment, files, cameras, access-control systems, servers, medical records, personnel information, or restricted network resources unless specifically authorized.
3. Prohibited Activities
Users may not use an MRFPD wireless network to:
Violate any federal, state, or local law or regulation;
Access, create, transmit, download, store, or distribute unlawful material;
Access or distribute threatening, harassing, defamatory, discriminatory, obscene, sexually explicit, or otherwise inappropriate material;
Infringe copyrights, trademarks, trade secrets, privacy rights, or other intellectual-property rights;
Conduct fraud, identity theft, impersonation, phishing, or other deceptive activity;
Gain or attempt to gain unauthorized access to any computer, account, network, server, camera, access-control device, or electronic system;
Scan, probe, test, monitor, intercept, or circumvent network security;
Introduce viruses, ransomware, malware, malicious software, or harmful code;
Interfere with, damage, disable, overload, or disrupt the network or another user’s device;
Spoof or falsify an internet-protocol address, email address, device identity, or network credentials;
Operate an unauthorized server, wireless access point, repeater, router, hotspot, proxy, or network-sharing service;
Share network passwords, access codes, or credentials with unauthorized persons;
Use peer-to-peer file-sharing, cryptocurrency-mining, high-bandwidth streaming, or similar services when such use affects network availability;
Engage in commercial advertising, political campaigning, solicitation, or private business activity without District authorization;
Access or transmit confidential District information without authorization;
Transmit protected health information, patient information, personnel records, criminal-justice information, passwords, or other sensitive information through an unauthorized application or service;
Use the network in any manner that could damage MRFPD’s reputation, compromise public trust, or interfere with emergency services.
4. No Expectation of Privacy
Users should have no expectation of privacy when using an MRFPD wireless network or District-owned technology resources.
To the extent permitted by law, MRFPD may monitor, record, filter, inspect, preserve, or disclose network activity for purposes including:
Network administration and cybersecurity;
Protection of District systems and equipment;
Investigation of suspected misconduct;
Compliance with legal obligations;
Responding to subpoenas, court orders, public-records requests, or law-enforcement requests;
Maintaining continuity of emergency operations.
Monitoring may include connection times, device identifiers, assigned internet-protocol addresses, bandwidth usage, websites or domains accessed, security alerts, and other technical information.
MRFPD does not represent that it continuously monitors every communication or protects users from all harmful or inappropriate online content.
5. Network Security and User Responsibility
Wireless internet service may not be secure. Users are solely responsible for securing their devices, accounts, passwords, applications, and information.
Users should:
Use secure websites and encrypted applications;
Keep operating systems and security software updated;
Use strong passwords and multifactor authentication;
Disable unnecessary file sharing and device-discovery features;
Avoid transmitting sensitive personal, financial, medical, or confidential information;
Use a trusted virtual private network when appropriate;
Verify the correct MRFPD network name before connecting.
MRFPD is not responsible for unauthorized access to a user’s device, intercepted communications, compromised accounts, lost information, malware, identity theft, or other harm arising from wireless-network use.
6. Personal Devices
Users connecting personal devices do so at their own risk.
MRFPD is not responsible for providing technical support, repairing personal equipment, configuring personal devices, recovering lost files, or restoring damaged software.
MRFPD may block or disconnect any device that:
Creates a security concern;
Is infected or believed to be infected with malicious software;
Uses excessive bandwidth;
Interferes with emergency operations;
Violates these Terms or another District policy.
Connecting a device does not authorize the user to physically connect equipment to District network ports, computers, switches, servers, or other infrastructure.
7. Availability and Performance
Wireless internet access is provided on an “as available” basis.
MRFPD does not guarantee:
Continuous or uninterrupted service;
Any particular connection speed;
Compatibility with any device or application;
Access to any particular website or online service;
The accuracy, reliability, or safety of internet content;
Protection against viruses, malware, interception, or unauthorized access.
Service may be interrupted by maintenance, emergencies, equipment failure, power outages, weather, cybersecurity incidents, internet-provider outages, or operational requirements.
8. Content Filtering
MRFPD may use security controls, firewalls, bandwidth limits, content filters, and other technical safeguards.
The District may block websites, applications, ports, protocols, devices, or categories of content at its discretion. The failure to block particular content does not mean the content is approved or authorized.
Users shall not attempt to bypass filters or security controls through a virtual private network, proxy, alternate domain-name service, tunneling application, or other method unless specifically authorized for legitimate District business.
9. Emergency Operations
The wireless network shall not be relied upon as the sole means of contacting emergency services or transmitting emergency information.
During emergency incidents, severe weather, planned events, training, or other operational needs, MRFPD may immediately restrict or terminate guest and personal internet use.
Users shall not interfere with communications, dispatch systems, incident-reporting systems, medical documentation, security equipment, or any other District operation.
For an emergency, call 911 using a functioning telephone or approved emergency-communications method.
10. Minors
A parent, legal guardian, or responsible adult is responsible for the internet use of any minor under that person’s supervision.
MRFPD does not assume responsibility for supervising minors, controlling the information they access, or preventing exposure to objectionable internet content.
11. Violations and Termination
MRFPD may suspend or terminate network access immediately when it reasonably believes a user has violated these Terms, created a security concern, interfered with operations, or engaged in unlawful activity.
Violations may also result in:
Removal from District property;
Disciplinary action for members, employees, or volunteers;
Loss of District technology privileges;
Financial responsibility for damage;
Referral to law enforcement;
Civil or criminal proceedings.
MRFPD may preserve and provide relevant records or information to law enforcement or other government authorities as permitted or required by law.
12. Disclaimer of Warranties
To the fullest extent permitted by law, the wireless service is provided “as is” and “as available,” without warranties of any kind, whether express or implied.
MRFPD disclaims warranties concerning availability, security, merchantability, fitness for a particular purpose, noninfringement, accuracy, and reliability.
13. Limitation of Liability
To the fullest extent permitted by law, MRFPD, its Board of Directors, officers, employees, volunteers, representatives, contractors, and agents shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive loss arising from use of or inability to use the wireless network.
This includes loss of information, device damage, malware infection, unauthorized access, identity theft, interrupted service, financial loss, or exposure to objectionable content.
Nothing in these Terms shall be interpreted as a waiver of any sovereign immunity, official immunity, statutory protection, defense, limitation of liability, or other immunity available to MRFPD or its representatives under Missouri or federal law.
14. User Responsibility for Loss or Damage
To the extent permitted by law, a user may be held responsible for costs, losses, damages, claims, or expenses resulting from the user’s unlawful activity, intentional misconduct, unauthorized access, or violation of these Terms.
15. Changes to These Terms
MRFPD may revise these Terms at any time.
Continued use of the wireless network after revised Terms are posted or presented constitutes acceptance of the revised Terms.
16. Governing Law
These Terms shall be governed by the laws of the State of Missouri and applicable federal law.
Any legal proceeding concerning these Terms or use of the network shall be brought in a court of competent jurisdiction serving Cape Girardeau County, Missouri, unless otherwise required by law.
17. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.

19. User Acknowledgment
By selecting “Accept,” connecting to the network, entering a wireless password, or continuing to use the service, the user confirms:
The user has read and agrees to these Terms;
The user understands that the wireless network may not be secure;
The user understands that network activity may be monitored or recorded;
The user accepts responsibility for the user’s device and online activity;
The user will disconnect immediately if the user does not agree to these Terms.
